The short version
- You pay $500 once to build your site, then $150 a month to keep it running.
- Your site, hosting, domain, chat assistant and request form are included.
- You get 3 change requests every month. Extra ones are $20 each. Changes to what the chat assistant says count as change requests.
- The assistant has a monthly usage cap. If you go over it, the extra usage is billed to you on a separate bill.
- The minimum term is 3 months. Leave early and you pay half of the months left in that term.
- After the 3 months, your service continues month to month until you cancel.
- If a payment is missed, we message and email you on day 1, call you on days 3, 5 and 7, turn off your assistant and request form on day 7 after the last call, and take the site down on day 14. Getting the automation back on costs $50 and the site back up costs $25.
- We never promise you more calls, leads or rankings.
01Who this is between
This agreement is between Bellemark Systems, run by Alex McTevia in Newnan, Georgia ("Bellemark", "we"), and the business named in the signature box below ("you", "the client"). You confirm that the person signing is allowed to act for the business. Only the person who signs, or one person they name to us in writing, can request changes or cancel.
02What you get (Tier 1 Website Package)
- A custom website built around your business, services, towns and hours, designed to work well on a phone.
- Hosting and a domain name, both included in your monthly fee.
- A chat assistant on your site that answers common questions at any hour, using only the information you give us. It answers questions. It does not collect customer details or book jobs.
- A request form. When a customer fills it in, it is sent to the email you choose.
- Change requests, as described in section 06, and ongoing care of the site.
03What is not included
The Tier 1 package is a website and a chat assistant that answers questions. These are not included, and we will quote them separately if you want them:
- Paid ads and search engine optimization work.
- Writing large amounts of new content, or taking photos or video.
- Extra pages, new sections, a remodel or a redesign. These start at $250 and are quoted before we begin.
- Business email setup, a customer database (CRM) and lead capture. These come with a higher tier.
04What it costs
| Item | Amount | When |
|---|---|---|
| Website build | $500 | Once, before we start work |
| Monthly service | $150 | Every month, same date, by card |
| Extra change requests | $20 each | Only when you go over your allowance |
| Priority change requests | $20 each | Only when you ask for faster turnaround |
| Bigger work (new pages, remodel, redesign) | From $250 | Quoted and approved before we start |
| Automation reactivation | $50 | Only if your assistant and request form were turned off for missed payment |
| Site reactivation | $25 | Only if your site was taken down for missed payment |
The monthly service includes up to $20 of chat assistant usage each month, and that is the monthly usage cap. On average a message costs about $0.01 to answer, which is roughly 2,000 messages. That is an average, not a promise. If you go over the cap, the extra usage is billed to you at the current market price on a separate bill. We will send you the confirmed price in writing before any overage is billed. Payments are taken through Stripe. The build fee is non refundable once we start work.
05Your start date and what we need from you
We start building once the build fee is paid and you have sent us the information on our intake form. You agree that what you send us is true and that you have permission to use any photos, logos and customer reviews you give us. If we are waiting on you, the schedule waits too.
- Revisions before launch: you get 2 rounds of changes to the first version of your site. Anything after that is handled as a change request under section 06.
- Approval: your site does not go live until you approve it in writing. A text or email saying "approved" is enough.
- Your content: you confirm the photos, logos, text and reviews you send us are yours or you have permission to use them. You are responsible if they are not.
- Go live date: your 3 month minimum term and monthly billing start on the day your site goes live, or 30 days after you pay the build fee, whichever comes first. We will confirm the date with you in writing.
- Delays on your side: if we are waiting on information from you for more than 14 days, the build pauses until we get it.
06Changes and support
A change request is a small update to your existing site. Examples: a new phone number, a changed service area, adding or removing a service, new hours, a new photo, a text edit or a price update.
Bigger work is not a change request. A new page, a new section, a remodel of the site or a redesign is quoted separately, and starts at $250. We will always give you the price and get your yes before starting.
- You get 3 change requests every month. Unused requests do not carry over.
- Changes to what the chat assistant says or knows count as change requests.
- Each extra request in the same month is $20.
- Standard changes are done within 3 business days. A priority change is done within 1 business day and costs $20.
- Send change requests only through the change request form we give you. Requests sent by text, call or message may not be counted or completed.
- Support: you can reach us Monday to Friday, 9 am to 4 pm Eastern, by message or call. We reply within 1 business day.
07Minimum term and cancelling
- The minimum term is 3 months from the day your site goes live.
- If you cancel during those 3 months, you pay half of the monthly fees for the months that are left. For example, cancel during month 1 and you pay half of month 2 and half of month 3, which is $150. Cancel during month 2 and you pay half of month 3, which is $75. The month you cancel in is already paid for.
- After the 3 months, your service automatically continues month to month at $150 a month. There is no new minimum term.
- You can cancel at any time after the minimum term. Tell us in writing (a text or email is fine) before your next billing date and you will not be charged again.
- When you cancel, the site is taken down. On request we give you a copy of your site files.
08Who owns what
- Bellemark owns the website design, the code, the hosting account and the domain name while your service is active.
- You own your business name, logo, photos, written content and customer information. You give us permission to use them to build and run your site.
- You allow Bellemark to show your site and a screenshot of it as an example of our work, and to keep a small "Built by Bellemark" credit in the footer of your site.
- If you cancel, we will transfer the domain to you for a flat $25 transfer fee, once any balance owed is paid. We keep your website running until the transfer is done so it does not go dark. After that the site comes down, and you can ask for a copy of the site files.
09If a payment is missed
- Day 1: we send you a message and an email. Many failed payments are just an expired card.
- Day 3: we call you, at the best time you gave us on the intake form.
- Day 5: we call you again at that time.
- Day 7: we make one last call. If the payment is still not made, we turn off your automation before 3:30 pm Eastern. That means your chat assistant and request form stop working. Your site stays up.
- Day 14: if the payment is still not made, your website goes down until payment starts again. Your files are kept safe.
- These deadlines are not random. They are the same fixed schedule for every client, so you always know what is coming.
- If you did not give us a best time to reach you, we call during normal business hours.
- To start things back up, you pay what is owed plus a $50 fee to bring the automation back up, and a $25 fee to bring the site back up if it was taken down. Each part goes back up as soon as it is paid.
10About the chat assistant
The assistant is an automated tool, and your site says so. It answers using the details you give us. You are responsible for those details being correct and up to date. It does not give legal, medical or safety advice, and it does not quote prices or make promises on your behalf unless you tell us to. If it does not know something, it says so and points visitors to your request form.
11No promises about results
We build the site and the assistant carefully and keep them running. We cannot promise any number of visitors, calls, leads, jobs or search rankings. Results depend on your business, your area and many things we do not control.
12If something goes wrong
We will always work to fix problems with the site quickly. We do not guarantee the site will never be down. Services we depend on, like hosting and payment providers, can have outages outside our control. To the extent the law allows, our total responsibility to you for any problem is limited to the amount you paid us in the 3 months before the problem happened.
13If we disagree
If something goes wrong, call or message us first and give us a chance to fix it. Most problems can be sorted out in a short conversation. We ask the same of you before you dispute a charge or post a public complaint.
14The rest
